Allegations Against the Airline
The complaint, filed by Karleasa Mitchell of King County, accuses the airline of violating the state’s Commercial Electronic Mail Act (CEMA). It claims Southwest used subject lines that created false urgency around sales and special promotions.
Example of the Companion Pass
One cited example is the February 2025 Companion Pass promotion. Southwest advertised a strict February 20 deadline and even sent a “LAST DAY” reminder. Yet, the airline extended the promotion the very next day, misleading eager customers.
Customer Concerns
Mitchell argues that the airline knowingly created urgency to drive sales. She clarified she does not want to unsubscribe from Southwest’s marketing emails but insists the company must stop sending misleading ones to customers.
Potential Penalties
If the lawsuit succeeds, Washington residents who received these emails may claim damages of $500 per violation under CEMA. Southwest has not responded publicly yet, but such practices could harm consumer trust far more than they boost sales.
