F-1 to H-1B Visa Change Triggers Tax Deduction Mess

A change of status from F-1 to H-1B has created confusion over tax deductions for a new visa holder. The issue has surfaced just as the 2025 tax filing season approaches, adding to existing uncertainty.

An Indian national shared that studies in the US continued from August 2021 to May 2025 on an F-1 visa. After graduation, Optional Practical Training began, followed by full-time employment starting in July 2025.

In October 2025, the individual transitioned to an H-1B visa through change of status. Earnings continued under the new visa until December, which is where the tax situation has become complicated.

For the 2025 tax year, the plan is to file as a nonresident alien. Under the US-India tax treaty, Indian students and business apprentices can claim the standard deduction, which is usually not available to nonresidents.

The complication arises because the individual held two visa statuses during the same year. Part of the year was spent on an F-1 visa, while the remaining months were under H-1B status.

The standard deduction can significantly reduce taxable income. For Indian students moving to work visas, this difference could translate into several thousand dollars, making the decision extremely important.
