Third-Country H1B Booking Allowed, But No Approval

An Indian H-1B applicant faced a setback during his renewal process after receiving an unusual response from the visa officer at the London consulate. The case has sparked debate among visa holders affected by recent policy changes.

Renewal in Third Countries

The applicant had booked an H-1B renewal appointment in London before the new policy, which disallows scheduling in third countries. The US State Department stated that such existing appointments would remain valid despite the change.

Shock at the Consulate

At the interview, the officer issued a 221(g), which requires additional review. While clarifying that nothing was wrong with the application, the officer said the updated rule ensures interviews take place but does not guarantee visa approval.

Facade of Appointments

This means that renewals booked abroad before the rule change will still be processed, but approval may not follow. Even a flawless application risks refusal, making the interviews appear like mere formalities.

Netizens React Online

Social media users criticised the approach, saying the consulates keep slot booking fees but deny approvals using the policy as cover. Many believe this practice is unfair, leaving applicants stuck in uncertainty despite following the rules.
