
A birthday trip to India has reportedly turned into a visa crisis for an H 1B worker. An Indian woman recently shared that her visa was cancelled during preclearance at Abu Dhabi airport. Her husband, however, was cleared without any issue.
The woman had travelled to India in November to celebrate her daughter’s first birthday. She and her husband completed their H 1B visa stamping on December 12. This was before social media screening changes came into effect on December 15.
In January, the couple began their return journey to the United States with a layover in Abu Dhabi. At the preclearance counter, her husband was allowed to proceed. She was reportedly stopped for additional questioning.
The officer allegedly asked about her two month stay in India. She explained that it was a combination of vacation and work. She had used paid time off for most days but also worked partially from India.
This response reportedly led to secondary inspection. Officials informed her that working from India was not mentioned in her Labor Condition Application. They also questioned the duration of her stay.
Her H 1B visa was then stamped “Cancelled and Withdrawn” at the airport. She was told to apply for fresh visa stamping. At present, appointment slots in India are reportedly unavailable.
According to her company’s attorney, there is no blanket rule that prohibits remote work from India while employed by a US firm. Despite this, she remains outside the United States waiting for a new appointment.
The incident has created anxiety among H 1B workers who frequently travel to India. Many rely on temporary remote work during family visits. The case highlights how visa issues can arise unexpectedly during travel.
