A recent study found that half of Indian Americans say they’ve faced unfair treatment in the U.S. in the past year. The most common type of unfair treatment reported is discrimination based on skin color, especially targeting those with darker skin. Now we have another such case.
JPMorgan Chase & Co. faces allegations of unlawful termination and discrimination in a recent federal lawsuit filed by Prafull Khare, an Indian software developer employed on an H-1B visa.
Khare asserts that he was unfairly dismissed after raising concerns about race and national origin discrimination within the company.
According to Khare’s complaint filed in the US District Court for the Eastern District of Texas, executives at JPMorgan Chase assigned him tasks inconsistent with his job duties outlined in his visa application.
Furthermore, he claims they subjected him to undue scrutiny, searching for flaws and misrepresenting his work performance.
Khare alleges that after he spoke out against the perceived discrimination, the company retaliated by terminating his employment, a violation of the Civil Rights Act.
As an H-1B visa holder, Khare was employed as a vice president of product management at JPMorgan Chase’s offices in Plano, Texas, where he focused on cloud networking. However, he contends that executives unfairly burdened him with unrealistic tasks and misrepresented his work.
The lawsuit seeks back pay and compensatory damages for Khare.
