Filing for a STEM OPT extension is stressful enough, but when HR blocks the process, it turns into a disaster.
One OPT student shared his ordeal on social media. He claims when he asked for the company’s E-Verify number HR responded by telling them to get a court subpoena.
Netizens are baffled at this demand of the court’s intervention just to access a number the company already has and is required to share for immigration purposes. Even his university’s DSO was stunned and advised to contact a lawyer.
The company’s manager did try to help but even he didn’t know enough details to provide the OPT with his e-verify number. Eventually, the manager gave up and told the employee to follow HR’s court advice.
Fellow users confirmed this isn’t normal and the company is responsible for providing the paperwork not the court.
This kind of HR negligence could cost someone their legal status. It’s more than just bad service, it’s about a person’s survival in an alien country.
At this point, the worker has only a few options—escalate higher within the Company, or get the DSO to send a formal email. But when your HR becomes the biggest threat to your immigration status, it’s not out of bounds to start looking for a new job.
