OPT Workers in Panic: Lay Off Threatens H-1B

A worker on STEM OPT has found himself in a tough spot as uncertainty looms over his H-1B status. Although he was selected for the lottery this year, his company can lay him off before the visa is finalized in September.

Taking to social media, the OPT worker claims he received a warning notice from his company, announcing there will be layoffs in late June. As their H-1B application hasn’t even been filed yet, the immigrant worker is in a panic.

Reacting to his post, other H-1B lottery winners also came out sharing how they are in the same situation. These are ominous reminders for everyone about the current situation of immigrants in the US.

And sadly there’s nothing much one can do either. They can file for a premium process or request for severance till their H-1B application is filed, but there’s no guarantee that the employer will comply.

If you’re laid off before your petition is filed, you’ll be in a much worse position. But don’t panic just yet—if the petition is filed and then you’re laid off, you may still have a chance to transfer your petition to another employer.
