Election commission chief Gyanesh Kumar had been facing a peculiar challenge as the people of the country have started to protest against his candidacy.
This matter has now reached the Supreme Court as a petition has been filed to suspend him from the duty immediately in view of the allegations against SIR, Form 6, and EVM discrepancies.
There was a lot of anticipation on this matter as the Supreme Court had to deliver a crucial verdict regarding the same.
The Supreme Court refused to pass any interim order to suspend the Chief Election Commissioner Gyanesh Kumar over allegations that he took decisions unilaterally in the Election Commission of India, without consensus from the two other Election Commissioners.
However, the bench headed by CJI Surya Kant issued notice to the Election Commission of India seeking their response on the allegations made in the plea.
The Court indicated that if, after considering the ECIs response, it finds that certain decisions were taken by CEC without the required unanimity, it could reconsider or recall those decisions.
“After notice, if they come and show that any decisions were taken without unanimity, we will take those decisions back” it said. This is a significant enough warning to Gyanesh Kumar.
