Supreme Court ruling on Kodandaram MLC

The Supreme Court has delivered a landmark ruling, cancelling the MLC appointments of Prof Kodandaram and journalist Amer Ali Khan under the Governor’s quota. The court clarified that future nominations for these vacancies must follow its final verdict.

Dasoju Sravan and Kurra Satyanarayana had approached the Supreme Court after then Telangana Governor Tamilisai Soundararajan rejected their nominations citing political ties. The bench, led by Justice PS Narasimha and Justice Atul S Chandurkar, gave its verdict on Wednesday.

The next hearing is scheduled for September 17. The Supreme Court also revised its August 14, 2024, ruling. This ensures the final decision will guide all further MLC nominations in Telangana.

Previously, the BRS government had nominated Dasoju Sravan and Kurra Satyanarayana as MLCs. Governor Tamilisai Soundararajan had rejected their names, stating they were politically linked. KCR did not resubmit their nominations, leaving the positions vacant.

After Revanth Reddy became Telangana Chief Minister in December 2023, he nominated Prof Kodandaram and Amer Ali Khan as MLCs in January 2024. The Governor approved their nominations, prompting a writ petition from Dasoju Sravan and Kurra Satyanarayana in the High Court.

The High Court overturned Governor Tamilisai’s decision, cancelling the nominations of Prof Kodandaram and Amer Ali Khan. However, it permitted the government to nominate MLCs again. Subsequently, the Telangana government resubmitted Kodandaram and Amer Ali Khan’s names.

Dasoju Sravan and Kurra Satyanarayana then appealed to the Supreme Court. In August 2024, the court lifted restrictions on Kodandaram and Amer Ali Khan’s nominations, allowing them to take oath as MLCs. The Supreme Court clarified that the final verdict will decide all future nominations.

Meanwhile, the plea of Dasoju Sravan and Kurra Satyanarayana to be nominated as MLCs remains unaddressed. The court highlighted that MLC nominations are ultimately decided by the Cabinet. Currently, Dasoju Sravan serves as an MLC under the MLA quota.
