H-1B applicants are facing a fresh setback in 2025. Even after paying for premium processing, which promises a decision in 15 days, many are still stuck waiting for weeks without clarity on their status.
Rising Requests for Evidence
The main reason for these delays is the surge in Requests for Evidence (RFEs). Once an RFE is issued, the 15-day premium clock stops. It only resumes after the US Citizenship and Immigration Services (USCIS) receives the applicant’s response.
Delays Despite Responses
Applicants say the process is far from quick. Even after submitting complete RFE responses, they often wait weeks. Case trackers show “Response to USCIS’ Request for Evidence Was Received,” but no final update follows.
A Struggling System
With the immigration system already under strain, added restrictions and stricter scrutiny have made H-1B approvals even tougher. Many workers who won the lottery are now left stranded without confirmation of their work visas.
Premium Processing Doubts
Applicants feel frustrated as the extra money spent on premium processing gives no real guarantee. Under the Trump administration, approvals are uncertain. Some come in two weeks, while others face months of unexplained delays.
