Failed Relationship Is Not Rape: Supreme Court

Supreme CourtThe Supreme Court has passed an interesting statement in the context of live in relationships and pre-martial sex between partners.

“Every failed relationship cant be considered as rape. If two partners are having consensual and prolonged physical relationship, then they should be open to all possible consequences.” The Supreme court stated.

The court made this statement in connection with a case where a 30-yr Madhya Pradesh woman filed rape charges against her 31-yr partner, saying he had a sexual relationship with her in the pretext of marriage.

“You either live the conventional way, or live by your standards which might include sexual relationships. In case of the latter, you cant come to the court, claiming rape charges just because you had a failed relationship in the pretext of marriage. This takes away the credence from a genuine case of sexual assault and rape” the supreme court opined.

The court opined that many couples in metropolitan cities and towns are inclined towards physical relationships prior to marriage and they cant come running to the court everytime their relationship fails as this is a consentual move.
