Adults can choose who to marry or spend their lives with without the interference of anyone be it their families. Allahabad High Court implied the same in a statement while criticizing the order of a magistrate sending a woman (petitioner 1) to live with her uncle after her uncle (respondent 3) lodged an FIR against her husband.
The order came even after the woman expressed fear for her life from the uncle. Her uncle was upset over her marrying the man of her choice which led to an FIR against her husband and the magistrate’s direction.
The magistrate’s direction is the proof of the fact why people fear to choose their partner on their own. Our society has instilled it deeply to follow the tradition of arranged marriage and anyone deviating from that is faced with scrutiny, even in today’s age.
It is true that someone’s family could not approve of the partner one chooses but it does not give them the right to prevent them from doing so, especially legally, which happened in this case.
Allahabad High Court has given several decisions over family issues and this one is among them. It has been welcomed by many given it ensures the basic right to freedom.
