H-1B Shock: RFE Disappears, Relief or More Scrutiny?

H-1B applicant checks USCIS RFE status update

An unusual USCIS case update has left an H-1B applicant searching for clarity after a request for evidence (RFE) reportedly disappeared from the case history. The development has sparked questions about what such a status change could mean for the pending petition.

The applicant shared the experience on Reddit and said the H-1B petition is being processed under premium processing. According to the post, USCIS initially issued an RFE. The applicant’s attorney then submitted a response, which was received by the agency on May 22.

The case status reportedly changed to “response received” on the same day. Shortly afterwards, another update indicated that the premium processing clock had stopped. At that stage, the applicant believed the case was moving through the normal review process.

A week later, the situation became more confusing. The applicant claimed the status briefly changed to “Case Is Being Actively Reviewed By USCIS.” Soon after, the status was reportedly updated again to “Cancellation Notice for RFE.”

According to the applicant, the notice stated that USCIS had cancelled the request for additional evidence related to the Form I-129 petition. The update also noted that the agency would issue another notice if any further evidence was required.

The unexpected sequence of updates left the applicant unsure about the next step. They asked whether others had experienced a similar pattern of status changes. The applicant also wanted to know if such cases typically resulted in approval, denial, or another RFE.

For many H-1B workers, petition outcomes can directly affect employment plans and immigration status. Recent reports of RFEs in visa cases have increased uncertainty among applicants. As a result, unusual USCIS updates continue to draw attention from those awaiting decisions on their petitions.
