Techie’s India Return After H-1B: Relocation or Resign?

An Indian techie is facing a tough career decision after his employer assured him of filing for an H-1B visa this year. At the same time, he has already decided to return to India. The conflicting plans have placed him in a difficult position.

He is currently working in the US on STEM OPT after completing his studies on an F-1 visa. Over the past two years, he has gained backend and cloud experience. Despite stable progress, he plans to relocate to India later this year.

For a long time, he was clear about moving back home. However, the situation changed when his employer informed him about the H-1B filing. The company requested documents such as passport copies, degree certificates, and marksheets to begin the process.

Although he does not intend to stay long term, he submitted the documents. He did not want to risk being treated differently at work. Meanwhile, he has planned a trip to India in May for a few weeks before returning briefly to the US.

His final relocation to India is scheduled for August. Now he is questioning whether securing an H-1B visa could help if he chooses to return to the US in the future. At the same time, he feels uneasy about quitting soon after the filing.

He has confirmed that he has not signed any repayment agreement. Still, the idea of resigning a few months after the H-1B petition makes him uncomfortable. The moral and professional dilemma continues to weigh on him.

Other Indian techies who faced similar situations have shared mixed advice. Some suggest securing the H-1B and requesting an India relocation to keep future options open. Others believe that if he is certain about returning, he can resign after the visa process.
