The US Citizenship and Immigration Services (USCIS) has confirmed that the FY 2027 H-1B lottery process is complete. With a large number of applicants each year, many from India have not been selected and are now exploring alternative pathways.
Immigration attorney Daniel Larson has advised applicants to stay calm and avoid panic. He highlighted that several legal options are available for those who missed out on the H-1B visa this year.
One such option is the J-1 trainee or intern visa. While it is not a shortcut, candidates with the right academic background can use this route effectively if they follow the rules properly.
Another alternative is the O-1 visa, which is gaining attention recently. Though often linked with celebrities, skilled professionals like engineers, researchers, and startup founders can also qualify with a strong profile.
Applicants can also consider working with H-1B cap-exempt employers such as universities. This route does not depend on the lottery and may allow part-time roles alongside private sector work in some cases.
Larson also mentioned the Day 1 CPT option, which remains legal but requires careful planning. Candidates can enrol in a recognised academic programme to gain work authorisation under an F-1 visa.
Pursuing a master’s or PhD from a reputed institution can strengthen one’s profile. It also allows candidates to stay in the system and apply again for the H-1B lottery in the following year.
There is also a possibility of a second lottery round around August if the visa cap is not fully utilised. However, experts caution applicants against depending entirely on this option due to changing visa regulations.
Overall, while missing the H-1B lottery can be disappointing, multiple alternative routes still exist. A strategic and informed approach can help applicants continue their plans to work in the United States.
