Their petitions were filed under the cap-exempt category, which is reserved for specific universities or research institutions. However, these applicants weren’t employed by such organizations. It turns out, this was just a simple mistake made by their legal team.
USCIS caught the discrepancy and issued a Request for Evidence. They asked for documents that would justify why the applicant should be considered cap exempt. Unfortunately, there are no such documents because the individual was actually chosen in the regular H1B lottery.
The error stems from a small yet crucial part of the application form. A checkmark was mistakenly placed under the cap-exempt category, even though the lottery letter clearly indicates that the candidate was selected under the standard cap.
Now, some attorneys are working to resolve the issue by submitting an amended petition. They’re hopeful that USCIS will accept the correction and continue processing the case based on the original lottery selection.
