The U.S. government shutdown has directly affected visa holders. One H-1B worker’s I-9 processing is now on indefinite hold, leaving both the employee and employer stuck until the system reopens.
Immigration Services on Hold
During a shutdown, the Department of Labour stops all immigration-related work. USCIS has also confirmed that its E-Verify system is not functional. Without it, employers cannot file new cases, leaving immigrant workers waiting without clarity.
Employment-Based Petitions Delayed
No new Labour Condition Applications, PERM applications, or similar documents are being processed. This has put all employment-based petitions on pause until the government resumes operations. Employers and applicants are forced into a standstill.
Consular Services Still Running
USCIS and the Department of State continue consular services. These remain active because many visa processes are funded by application fees, which are unaffected by the shutdown. Some applicants may still access these services despite the disruption.
I-9 Verification Halted
For now, cases like the H-1B holder’s I-9 remain suspended. Employers must hold the worker’s paperwork until the verification system returns online. This pause increases uncertainty for both sides of the hiring process.
Shutdown’s Broader Impact
The shutdown highlights how fragile the position of foreign professionals is in the U.S. With documents stuck in processing, many cannot work. Employers across industries face delays, slowing crucial hiring activities nationwide.
