Is Skipping H1B Visa Stamping Risky for Status?

Skipping H1B stamping and US visa risks

For one H1B visa holder, the plan is simple: avoid travel for over two and a half years. The last visa stamp was in March 2023, and the next international trip won’t be until September 2026. That raises the question—is skipping H1B stamping for so long risky?

Immigration experts say no. A visa stamp only allows you to enter the United States. It does not determine your legal status once you are inside the country. As long as your I-94 record is valid and you are employed by your sponsoring company, you remain in lawful H1B status even without a recent stamp.

The challenge arises only when you travel abroad. To re-enter the US, you must obtain a fresh visa stamp through a consulate interview. At that point, officers may ask for proof that you stayed in proper status during your entire stay. With complete documentation—approval notices, pay stubs, and employment verification—most applicants are able to clear this step without issue.

Long gaps between visa stamps are common for Indian H1B holders who prioritize stability in the US over frequent international travel. However, one practical concern is appointment availability. Given the heavy demand at US consulates, scheduling a stamping appointment in advance is essential to avoid delays.

For many, years without stamping mean missing family events and trips back home. But when the day finally comes to travel again, it becomes more than just a vacation—it marks a milestone in the long journey of pursuing the American dream.
