Unclear Payment and Refund Rules
The fee aims to discourage visa overstays and is refundable if rules are followed. Yet, neither the Department of Homeland Security nor the Department of State has explained how to pay it or claim a refund, leaving applicants unsure and worried.
Difference From H-1B $100,000 Payment
This integrity fee differs from the $100,000 H-1B payment required for entry of new H-1B holders. The integrity fee applies to all non-immigrant visas, while the $100,000 fee is specific to H-1B visa issuance and does not affect approvals or stamping.
Legal Standing and Permanence
Unlike the H-1B fee, the $250 integrity fee is part of a Bill passed by Congress. While the White House may face court challenges, the Bill has no legal hurdles so far, making the fee more permanent and harder to reverse.
Rising Panic Among Applicants
Silence from the agencies fuels concern as applicants scramble to understand both fees. Immigration policies continue to change without clear guidance, and experts remain skeptical. The lack of clarity leaves applicants stressed and unsure about compliance and refunds.
