
The Supreme Court has given a sensational ruling regarding compensation for the family of a woman who died due to a bus accident. The Apex Court directed APSRTC to pay the family of the deceased Rs 9,64,52,220.
The woman was working in the US. A jury comprising Sanjay Karol and Prashantkumar Mishra gave the judgement to this affect.

Lakshmi Nagalla was travelling from Annavaram to Rajamahendravaram on June 13, 2009, along with her husband and two daughters when a RTC bus hit their vehicle. Lakshmi died in the accident.
The deceased had studied computer science in the US and was a US citizen. She was earning $11600 per month. Her husband Shyamprasad Nagalla lodged a case with Motor Accident Tribunal in Secunderabad stating that the RTC should give them Rs 9 crore in compensation. The accident had occured due to irresponsible driving, he accused.

Following this, in 2014, the Tribunal directed RTC to give Rs 8.05 crore to the family. Meanwhile, RTC approached the Telangana High Court.
The Telangana High Court made some changes after taking into consideration Tribunal’s calculations and directed RTC to pay Rs 5.75 crore.

The husband of Lakshmi then approached the Supreme Court. After considering the matter, the SC directed APSRTC to compensate Rs 9,64,52,220 to the family.
The amount was decided based on the dollar rate which was Rs 57 at the time of Lakshmi’s death. Had 43-yr-old Lakshmi been alive, she would have worked for another 14 years. This was one factor that SC took into consideration.
The Apex Court said it was making some changes to Secunderabad Motor Tribunal’s decision. The amount has to be paid with 7.5% interest as the Tribunal suggested, said SC.
