Ruling in a case of domestic dispute, the Karnataka High Court has stated that calling your partner dark skinned will amount to cruelty. A man in Karnataka has alleged that his wife often humiliated him for being dark skinned. He claims that he suffered the humiliation only because of their child.
The couple who got married in 2007, filed for a divorce petition in 2012. The wife had alleged at that time that his husband and his family including his mother subjected her to cruelty and also filed police complaint against them. This forced the man to appear in police station and courtrooms. He later filed for divorce on grounds of mental torture incurred on him.
The wife had also claimed that the man had a relationship with another woman that continued even after their marriage. Their divorce petition was dismissed by family court in 2017 when the court described their situation as “normal wear and tear”. The woman has refused to take back any of her complaints against the man.
The court concluded that the wife used to insult his husband on the basis of his skin colour and also moved away from his husband without any reason. The Karnataka High Court observed that this humiliation along with false claims of illicit relationship amounts to cruelty.
