The proposed regulation will not encompass every OTT communication app but only a select few, based on specific criteria such as turnover and user base.

To reflect a light-touch regulatory stance, the government has opted for the term ‘authorization’ rather than ‘license’ for these OTT apps. This move avoids imposing heavy fees and stringent regulations on them, aligning with the government’s agenda of fostering innovation and growth in the sector.

The Department of Telecommunications (DoT) is actively pushing to introduce the Telecom Bill during the current monsoon session of Parliament or, if necessary, in the winter session. All stakeholder consultations have been completed, and the draft bill is currently with the legislative department for further refinement.

Notably, the new version of the Bill has reportedly reduced penalties for breaches of terms and conditions after discussions with the home ministry. The emphasis is on encouraging alternate dispute mechanisms, promoting mutual settlements rather than resorting to litigation.

Well, certain contentious provisions have been removed to eliminate overlaps of regulations with other ministries. For instance, a provision related to mergers, demergers, and acquisitions of telecom licensees has been removed after concerns raised by the commerce ministry.

Throughout this process, public consultation has been pivotal in shaping a balanced and forward-looking regulatory framework. The government’s efforts aim to strike a balance between nurturing a vibrant digital ecosystem and safeguarding consumer interests.

Final version of the Telecom Bill is still awaited, it is evident that the Indian government is keen on supporting innovation and growth in the OTT communication app sector without stifling it with unnecessary red tape. The selected regulation of OTT apps represents a pragmatic step towards harnessing the potential of digital communication while ensuring compliance with essential standards.
