A green card applicant is dealing with a major filing error after their lawyer mistakenly switched medical forms between the applicant and their spouse on the USCIS portal.
Medical Forms Uploaded Incorrectly
The applicant discovered that their own medical record appeared under their spouse’s profile, while their spouse’s form appeared in theirs. Both I-693 medical forms were uploaded to the wrong accounts, leaving the couple anxious about how to fix the mix-up.
Lawyer Acknowledges the Mistake
Their attorney had filed the I-485, I-765, and I-131 applications under the EB-2 NIW category. Once notified, the law firm admitted the clerical mistake and confirmed that they were taking steps to correct it. The error occurred before the couple’s scheduled biometrics appointment, which may now face delays.
Possible System Glitch or Human Error
Some experts believe the issue could be a technical glitch that might resolve itself. One applicant shared that a similar problem disappeared after logging in from a different device. Still, lawyers caution that such errors can have serious consequences if not fixed promptly.
Risk of Delays and Expired Medicals
The timing makes the situation more critical. USCIS medical forms are valid only for a limited period, and any delay could affect the entire green card process. Even a simple administrative error can push timelines back by months.
Accountability in Immigration Filings
Immigration attorneys say this is another example of poor oversight by legal representatives. Unless firms take stronger responsibility for such mistakes, applicants will continue to bear the cost of clerical negligence in their immigration journeys.
