U.S. Judge Roy Altman has already rejected Burger King’s attempt to dismiss the class action by customers and has notified the company that they must address the claim.

According to the lawsuit, it alleges that Burger King deceives customers into believing that their burgers contain 35% more ingredients and appear to have double the amount of meat than they actually do.

Now, amidst all this, Burger King stated that they haven’t made any promises regarding surviving a picturesque. But the judge ordered it to leave it to the jurors whether it is self-explanatory or not.

On Tuesday, Burger King refuted the plaintiffs’ claims, affirming that the beef patties in their ads match those in the Whopper sandwiches served nationwide. No comment from the plaintiffs’ lawyer was available, and earlier settlement talks were unsuccessful.

They are not the only fast-food company who is fighting actions like this. McDonald’s, Wendy’s, and even Taco Bell are currently fighting such lawsuits, each carrying $5M in damages.
