H-1B Texas Indian Employer Paycheck Blackmail

A social media post highlighting an alleged payroll malpractice involving a Texas-based Desi employer has sparked outrage in Houston, Texas.

The employee, who is assumed to be on an H-1B visa, took to social media to express his concerns, stating that his employer had been withholding payslips for almost two years and paying him a salary that was below the agreed amount, in accordance with the LCA.

It says the employer is on ADP, one of the popular payroll and tax software, but he has never been given any access to his payslips.

Due to such a lack of transparency in his case, it is impossible for him to verify his earnings, demanding a ful salary in accordance with his agreement, including a certain percentage of the billing share above the amount stipulated in the LCA.

He wrote “He pays me salary per LCA rather than agreed amount and billing % share, which is more. So I cannot ask him all the pending amount as he is hiding the original amount/salary which i should be getting.”

“Now they don’t answer my calls,” the employee wrote adding that each time they ask about the issue, they are told that the payroll team is working to resolve it.

The employer only keeps responses vague with “issues with ADP” and thereafter goes silent for weeks or months.

The post went viral, and many others with similar experiences chimed in.




This raises questions about employer compliance with wage transparency law and worker protection, particularly for foreign nationals on LCAs, who are at an increased disadvantage in ensuring equal pay.
