H-1B Promotion Nightmare: $2 Raise Cancels PERM

H1B PERM reset green card delay

A small promotion has turned into a major setback for an H-1B worker, creating unexpected complications in the green card process. What should have been a career step forward has instead delayed long-term immigration plans significantly.

According to a recent account, the worker’s company restarted the PERM process after a title change from Engineer I to Engineer II. The job responsibilities remained almost the same, and the salary increase was only about $2.

Despite this minimal change, the employer refused to continue with the existing application. The company maintained that the green card filing must strictly match the exact job title and role mentioned during the PERM stage.

Since the I-140 petition had not yet been filed, the process has now been reset completely. The worker even attempted to reverse the promotion, but the company declined, stating that the H-1B extension had already been filed under the updated designation.

This situation highlights the rigid nature of the system, where even a small title change can disrupt years of effort. It raises concerns about how sensitive the process is to minor administrative updates.

For many Indian professionals, who already face long waiting periods for green cards, such setbacks can be very difficult. A reset in the process can extend timelines by several years and create uncertainty.

With stricter scrutiny in USCIS adjudications and a challenging job market, such issues only add more pressure. Cases like this show how careful planning is essential when handling promotions during the green card process.
