PERM Process Halted for H1B Worker

US firms are quickly adapting to tackle the current crackdown against immigrants. The job market has become more competitive with local workers getting an edge over highly-skilled international employees.

This was the experience of a techie whose PERM process was abruptly halted when their employer found a US worker who met the minimum qualifications.

The company is now restarting the process, but time is running out. With only two years left on H1B, this delay could be disastrous for the techie.

Now he is panicking with questions wondering in his mind about what to do next. Explaining it further on social media, he wrote, “My clock is ticking and unfortunately H4 EAD is not an option as my spouse is new on her H1 and she is looking for new jobs so we don’t have hopes on her I140 too.”

Netizens claim a new PERM process means restarting recruitment and possibly filing a new PWD. And then there’s always the risk of it failing again for the same reason.

The manager plays a key role but is mostly reliant on the law firm. If even one candidate meets the minimum criteria, the process ends.
