h-1b-cancelled-indians-punished-for-going-home

In a shocking update from the US, multiple Indian H-1B holders got their work visas terminated for overstaying in India. This appears to be another harsh crackdown on visas by the Trump administration, aimed at trapping individuals in legal loopholes.

Now, even a holiday to their home country can cost H-1B techies their livelihood in the US. Reportedly the reason behind the cancellation of visas is staying in India for too long while still earning a US salary.

Under Trump’s immigration-tightening policies, the line between a simple vacation and “visa misuse” is getting dangerously thin.

Earlier it was reported 2 Indians had their H-1B revoked at an Abu Dhabi preclearance. However, people were skeptical about its legitimacy as the reason for “overstaying” seemed too outlandish, considering workers have been doing this for decades.

But now, recent reports of 3 H-1B holders getting their visas revoked simply for working beyond five to eight weeks from India have thrown everyone at the deep end. Some didn’t even know they were breaking any rules until they were flagged at ports of entry or had their visas denied upon reapplication.

Amidst this crackdown, experts suggest not working from India for more than 4–5 weeks unless you’re officially on PTO (Paid Time Off). Staying with your family for 6 weeks can raise alarms for the authorities so always seek legal help before planning your next move.
