B1/B2 Entry to F1 Switch: USCIS Flags Student’s Intent

USCIS scrutiny on F1 visa applicant

An F-1 visa applicant has reportedly come under scrutiny after USCIS questioned his entry into the United States on a B1/B2 visitor visa. The student allegedly received a Notice of Intent to Deny (NOID), creating uncertainty around his plans to continue studies in the US.

The F-1 visa aspirant shared details of the case on Reddit and explained how USCIS questioned his original intention while entering America. Officials reportedly wanted clarity on whether he entered as a genuine visitor or had already planned to study before arrival.

According to the post, the NOID also referred to a Presidential Proclamation connected to visa eligibility and intent-based reviews. The applicant stated that USCIS raised concerns regarding compliance with immigration rules and the legitimacy of the status change request.

The student mentioned that a detailed response package is now being prepared to address the concerns. The documents reportedly include school admission papers, proof of financial support, personal statements, background records and additional explanations related to the case.

Several users responding to the post remained doubtful about the chances of approval. One user advised the applicant to prepare for immediate departure if the F-1 visa request gets rejected. Concerns were also raised about possible complications involving the existing B1/B2 visa status.

The discussion has attracted attention from Indian students living in the US amid growing fears around stricter immigration scrutiny. Immigration lawyers and visa applicants have repeatedly warned that switching from a tourist visa to a student or work visa has become increasingly difficult in recent years.
