An Indian PhD scientist from Yale faced a long and frustrating EB-2 NIW visa delay. They submitted their application in October 2023, expecting it to be processed within 9 to 10 months. Instead, the case remained stuck for over 26 months with no updates beyond “Case Was Received.”
Service Requests Ignored
The scientist holds eight publications and over 300 citations. Despite multiple service requests to USCIS, there was no response. With no other option, they contacted their local congressperson to launch a political inquiry.
USCIS Blames Visa Backlog
Only after the congressional inquiry did USCIS respond. The agency blamed the backlog of Indian EB-2 applicants for the delay and stated there was “no urgency” since the applicant’s I-485 filing date was still far away.
Confusion Over Approval Notice
The congressperson later informed the applicant that the case had actually been approved in January 2024. However, neither the applicant nor their attorney received any official approval notice from USCIS.
Case Approved After 26 Months
Frustrated and confused, the scientist turned to Reddit for advice. Coincidentally, their case was approved in November 2025—the same day they posted about it online. It had taken over two years since the original filing.
A Sign of Systemic Problems
The incident highlights deep flaws in USCIS’s communication and processing systems. Growing backlogs, unclear responses, and lack of transparency are leaving many applicants anxious and uncertain about their future.
