Against this backdrop, a recent ruling by the Uttarakhand High Court has attracted attention. The court clearly distinguished between a failed relationship and criminal wrongdoing.

The observation came while hearing a petition filed by Suraj Bora. The court quashed rape charges that arose from an alleged broken promise of marriage.

The complainant had stated that she consented to a physical relationship after being assured marriage within 45 days. The relationship later ended, leading to criminal proceedings.

Justice Ashish Naithani observed that consent given by an adult does not automatically become invalid if a relationship collapses later.

The court clarified that a promise of marriage amounts to rape only if it was dishonest from the outset. It must be shown that the promise was made solely to obtain consent through deception.

The judgment noted that a long term and repeated relationship between consenting adults suggests mutual involvement. Such circumstances do not automatically indicate initial fraudulent intent.

The court further stated that continuing criminal proceedings without clear proof of deception would amount to harassment of the accused. Legal action must be based on evidence, not emotional fallout.

While genuine cases of exploitation must be dealt with firmly, the ruling reinforces a crucial balance. Not every failed relationship can, or should, be treated as a criminal offence.
