No Marriage Needed for Family

In a progressive and compassionate ruling, the Madras High Court has reaffirmed the rights of same-sex couples to live together with dignity and safety. The court recently directed the police to ensure protection for a lesbian couple facing threats from their families, emphasizing that every adult has the right to make personal life choices, including whom to live with.

While same-sex marriage is not yet legally recognized in India, this judgment clarifies an important distinction although the law does not permit same-sex couples to marry, it does protect their right to cohabit and lead a life of their choosing. The court stressed that the absence of marital rights should not be mistaken as a denial of basic human rights and personal liberty.

The court highlighted that both individuals were consenting adults, and their decision to live together must be respected. It condemned any form of harassment or coercion against LGBTQ+ individuals and urged authorities to act without prejudice. This ruling reflects a broader shift in India’s legal system toward recognizing and protecting the dignity of LGBTQ+ citizens. It sends a clear message that the Constitution guarantees equal rights to all individuals, regardless of their sexual orientation.
