The latest legal issue involves Xiaomi, a well-known company for manufacturing smartphones, they face litigation regarding the utilization of LTE-Advanced (LTE-A) technology in its 4G handsets.
Sun Patent Trust, which owns more than 3,000 former Panasonic patents, has accused Xiaomi of using this sophisticated feature in their products from the year 2018 but without having a compulsory Panasonic license.
LTE-A is a significant technology as it provides the advanced values of 4G standards in terms of the speed and performance. Interestingly, Xiaomi is believed to have overlooked the legal obligation to discuss the possibility of a licensing deal with Sun Patent Trust.
The absence of comment has resulted in legal actions pursued in India and France with the Delhi High Court and the Paris Judicial Court set to be entrusted with the task of disposing off the infringement suits.
This civil action is one of those involving sums of over $300 million. The full-text judgments not only will potentially influence Xiaomi company’s financial situation but also will create precedent for the enforcement of patent law and license agreements negations.
